In California, Section 23152 of the California Vehicle Code states that:
a) It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.
b) It is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.
Presumed DUI in California
In California, the per se DUI blood alcohol content (BAC) level is .08. "Per se" means that a person driving with a BAC level of .08 or higher will automatically be charged with a presumed DUI.
A driver can also be convicted of a DUI with a lesser blood alcohol content if the officer deems that the driver's level of intoxication impairs his or her ability to safely and properly operate the vehicle.
